1. Agreement to Terms

By accessing or using IoData platform ("Service"), provided by Moonxi Tecnologia Ltda. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

IoData is an industrial IoT platform that provides:

• Real-time sensor data monitoring
• AI-powered anomaly detection
• Predictive maintenance alerts
• Data analytics and reporting
• Integration with industrial equipment

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payment

4.1 Pricing

Subscription plans start at $5,000 USD per month for up to 100 devices. Custom pricing is available for larger deployments.

4.2 Free Trial

We offer a 30-day free proof of concept. No credit card required for trial.

4.3 Payment Terms

Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as provided in our 90-day money-back guarantee.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to breach or test system security
• Interfere with other users' access to the Service
• Reverse engineer or decompile the Service
• Resell or redistribute the Service without authorization

6. Data Ownership and Rights

6.1 Your Data

You retain all ownership rights to your industrial data. We claim no ownership over your sensor data, configurations, or reports.

6.2 License Grant

You grant us a limited license to process your data solely for providing the Service, including anomaly detection and predictive analytics.

7. Service Level Agreement (SLA)

We guarantee 99.9% uptime for the IoData platform, excluding scheduled maintenance. Downtime credits are available as specified in our SLA documentation.

8. Limitation of Liability

To the maximum extent permitted by law, Moonxi shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or production downtime, even if advised of the possibility of such damages.

Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold Moonxi harmless from any claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

Either party may terminate this agreement with 30 days written notice. We may immediately terminate or suspend access for violations of these Terms. Upon termination, you may export your data for up to 90 days.

11. Governing Law

These Terms shall be governed by the laws of Brazil, without regard to conflict of law principles. Any disputes shall be resolved in the courts of São Paulo, Brazil.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes at least 30 days in advance. Continued use of the Service constitutes acceptance of modified Terms.
